Terms of Use

1. Agreement

By downloading or using the BootyMaxx app ("App"), you agree to these Terms of Use and to Apple's Licensed Application End User License Agreement (the "Apple EULA"). If these Terms conflict with the Apple EULA, these Terms apply to the extent permitted. If you don't agree, don't use the App.

2. Eligibility

You must be at least 13 years old to use the App. If you're under 18 (or the age of majority where you live), you may make purchases only with a parent's or guardian's permission.

3. Subscriptions and purchases

Subscriptions

BootyMaxx Pro unlocks unlimited scans, personalized training plans and all premium features. It's offered as auto-renewing subscriptions (for example, weekly, monthly and yearly). Prices and any discounted introductory offers are shown in the App before you buy and may vary by country.

• Payment is charged to your Apple ID account when you confirm the purchase.
• Your subscription renews automatically at the same price and for the same period unless you turn off auto-renew at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription anytime in iPhone Settings → [your name] → Subscriptions. Canceling stops future renewals. You keep access until the end of the period you've paid for.
• If a free trial is offered, any unused part of it ends when you buy a subscription.

Guest scan packs

Guest scan packs are one-time (consumable) purchases that give you a set number of scans without a subscription. Scans are used up as you use them, don't expire unless stated in the App, and aren't restored if you delete the App or reset its data.

Refunds

All purchases are processed by Apple. We can't issue refunds directly. To request one, visit reportaproblem.apple.com. Refunds are at Apple's discretion.

Restoring purchases

If you reinstall the App or switch devices, tap Restore Purchases on the paywall or in Settings to restore active subscriptions tied to your Apple ID.

4. Health and fitness disclaimer

BootyMaxx is not a medical device and doesn't provide medical advice. Booty Scores, metrics, AI feedback, workouts and nutrition suggestions are for general fitness and motivation only. They are visual estimates, not measurements, diagnoses or predictions, and results aren't guaranteed.

Talk to a doctor or qualified professional before starting any exercise or nutrition program, especially if you're pregnant, injured or have a medical condition. Stop exercising right away and get help if you feel pain, dizziness or shortness of breath. You exercise at your own risk.

5. Your photos and content

• You keep all rights to the photos and content you create in the App.
• You give us a limited, temporary permission to send your scan photos to our AI providers only to create your report, as described in our Privacy Policy.
• You agree to upload only photos of yourself. Photos must not include nudity, anyone under 18, other people without their consent, or anything unlawful.

6. Acceptable use

You agree not to misuse the App. That includes reverse engineering it, getting around purchases or scan limits, disrupting its services, using it to harass or body-shame others, or using it for any unlawful purpose.

7. AI-generated content

Reports are created by AI and may sometimes be inaccurate or inconsistent, for example because of lighting, clothing or camera angle. Use them as a general guide for your own progress, not as objective facts about your body.

8. Intellectual property

The App, including its design, text, graphics, workouts and software, is owned by BootyMaxx or its licensors and is protected by law. We give you a personal, non-transferable, revocable license to use the App on Apple devices you own or control, as allowed by the Apple EULA.

9. Changes and availability

We may update, change or discontinue features of the App at any time. We may update these Terms. If we do, we'll change the date above, and continuing to use the App means you accept the updated Terms.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, BootyMaxx won't be liable for any indirect, incidental, special or consequential damages, or for any injury from exercise. Our total liability for any claim is limited to the amount you paid for the App in the 12 months before the claim. Some places don't allow these limits, so they may not fully apply to you. Nothing here limits your rights under consumer protection laws.

11. Termination

You can stop using the App at any time by deleting it. Remember to cancel any active subscription in your Apple ID settings, because deleting the App doesn't cancel it. We may suspend access if you break these Terms.

12. Apple

These Terms are between you and BootyMaxx, not Apple. Apple isn't responsible for the App or its content, has no obligation to provide maintenance or support, and isn't responsible for any claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
